Welcome to DressBuddy. These Terms of Service (the „Terms") govern your use of the website dressbuddy.app and the associated mobile and desktop applications, services and content (collectively, the „Service"), operated by Artbit Ltd., UIC 202339243, with registered office at 34 Preslav Street, Yambol, Bulgaria (the „Company", „we", „us").

By registering or using the Service you confirm that you have read, understood and unconditionally accept these Terms. If you do not agree with them, please do not use the Service.

1. Scope of the Service

DressBuddy is an AI-powered personal styling app that:

• analyses your style profile from a reference photo you upload;
• generates personalised outfit suggestions from partner stores and/or your digital wardrobe;
• produces virtual try-on images with AI models;
• rates individual products („Should I buy it?") against your style profile;
• provides a peer-to-peer platform for listing/selling clothes („Marketplace").

2. Registration and account

To use the Service you must create an account with a valid email. You are required to:

• provide accurate and complete information;
• keep your sign-in credentials secret (password, magic-link inbox, OAuth account);
• be at least 16 years old; individuals under 16 may use the Service only with the consent and under the supervision of a parent or guardian;
• take responsibility for all actions performed through your account.

We reserve the right to refuse registration or terminate an account at our discretion, including for breaches of these Terms.

3. Credit system and payments

The Service runs on a credit basis. The following plans are available:

• Free — 20 one-time credits when your email is verified;
• Plus — €24.99/month, 100 credits/month;
• Pro — €49.99/month, 250 credits/month;
• Top-up — additional credits at €0.50 each.

Credits are deducted automatically for AI operations (generating an outfit, try-on image, product analysis, AI image when adding to the wardrobe, etc.). The exact cost of each action is shown in the Service before you confirm.

Payments are processed by Stripe. Subscription plans renew automatically each month unless cancelled before the next charge. Credits from a monthly subscription do not roll over — unused credits expire at the end of the billing period. Top-up credits do not expire while the account is active.

4. Right of withdrawal and refunds

Under Article 50 of the Bulgarian Consumer Protection Act you have the right to withdraw from a subscription or top-up within 14 days of payment, provided you have not used the credits. Refunds are made through the original payment method within 14 business days of the notice.

Consumed credits (executed AI requests) are non-refundable, as the service is digital and delivered immediately. By confirming a purchase you explicitly agree that we may begin execution immediately and that you lose your right of withdrawal for services already performed.

5. Photos and user content

To use core features of the Service you will be asked to upload a reference photo of yourself and/or photos of clothes. By uploading you declare and warrant that:

• you are the owner or have the necessary rights to the uploaded images;
• if the photo depicts another person, you have their explicit consent to AI processing;
• the photos do not contain minors without a parent or guardian's consent;
• the photos do not violate law, third-party rights or morality.

You grant the Company a non-exclusive, royalty-free, revocable licenceto process, copy, transform and transmit the photos to AI service providers (Anthropic, Replicate, Voyage AI) solely for the purpose of delivering the Service. The photos are not used to train our own models and are not sold to third parties. If you delete your account, the photos are permanently deleted within 30 days.

6. AI-generated content — limitations

AI recommendations, outfits, try-on images and analyses („AI Content") are informational and do not constitute professional styling advice or a guarantee of results. The Company:

• does not guarantee the accuracy, availability or price of products from partner stores;
• is not liable for purchase decisions made based on the AI Content;
• does not guarantee that a virtually generated image will match the real appearance of a garment after purchase;
• may remove or correct AI Content that contains obvious errors.

AI Content generated specifically for you may be used freely for personal (non-commercial) purposes, including sharing on social media. We reserve the right to use anonymised aggregated data (general statistics, trends) to improve the Service.

7. Partner stores and links

DressBuddy displays products from partner stores (H&M, Reserved, Mango, Modivo, LC Waikiki, Zara, About You, Answear and others). These stores are independent merchants — prices, availability, shipping, returns and product quality are governed by their own terms of sale. DressBuddy is not a party to the transaction between you and the partner store and is not liable for the store's non-performance.

The Company may receive an affiliate commission on purchases made through links in the Service. This does not affect the selection or ranking of recommendations shown to you.

8. „Marketplace" — peer-to-peer resale

The „Marketplace" section allows users to list their clothes for sale to other users. DressBuddy is only a platform and is not a party to the transactions. The seller and buyer arrange directly:

• description, condition and price of the item;
• method of payment and shipping;
• returns and complaints.

The Company does not guarantee the authenticity, quality or condition of items and does not process payments for these transactions. We reserve the right to remove listings that violate these Terms or applicable law.

9. Prohibited use

You may not use the Service for:

• unlawful purposes or infringement of third-party rights;
• uploading obscene, offensive, discriminatory or violent content;
• attempts at reverse engineering, scraping, bots or automated access to the Service without written permission;
• reselling or redistributing AI Content for commercial purposes;
• circumventing the credit system or other limitations;
• attempts to access other users' accounts or the Company's systems.

10. Intellectual property

The software, design, trade name „DressBuddy" and all related logos, texts, graphics and algorithms are the property of the Company and are protected by applicable intellectual-property law. Use of the Service does not transfer any rights over them to you.

11. Termination

You may terminate your account at any time via the profile settings or by writing to support@dressbuddy.app. Upon termination:

• your access to the Service ends immediately;
• the current subscription is not refunded pro rata (it continues until the end of the paid period);
• personal data and photos are deleted within 30 days (except those we are required to retain by law — financial records, invoices, etc.).

We reserve the right to terminate or restrict access for a user who breaches these Terms or harms the platform.

12. Disclaimer of warranties

The Service is provided „as-is" and „as available". To the maximum extent permitted by law, the Company is not liable for:

• indirect, consequential or special damages from use of the Service;
• loss of profit, data or reputation;
• interruption, delay or inaccuracy of the AI Content;
• actions of partner stores or other users;
• force-majeure circumstances.

The Company's total liability to you for any claims is limited to the amount you have paid over the previous 12 months.

13. Changes to the Terms

We reserve the right to update these Terms at any time. For material changes we will notify you by email or an in-app notice at least 14 days before they take effect. Continuing to use the Service after that date constitutes acceptance of the new version. If you do not accept the changes, you may terminate your account.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria. Disputes are first resolved through good-faith negotiations. Failing that, the competent court is the one at the Company's registered seat.

Under Regulation (EU) No 524/2013 you also have the right to use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
